Bylaws

The Osaka Fan Club (hereinafter referred to as "Club") and Osaka Fan Club Bylaws (hereinafter referred to as "Bylaws") are as follows. The act of registering and sending your personal information after checking to make sure it is correct is regarded as your agreement to the following bylaws.

Article 1: Membership/Bylaws
  1. Upon consenting to the Bylaws contained herein and upon completion of the stipulated enrollment procedure, the applicant shall be recognized as a "member" by the Club.
  2. If the Club deems an applicant to be inappropriate for membership, the Club reserves the right to refuse membership for said applicant. The Club also reserves the right to cancel membership of any member, regardless of whether or not said member has already been accepted.
  3. The Club reserves the right to revise the Bylaws without prior notification. Revised Bylaws shall apply to all members both prior to and after revision. Notification of revised Bylaws shall be provided on the website or by e-mail.
Article 2: Registered Information
  1. All membership registration information including e-mail addresses shall be the property of the Club.
  2. False declarations shall not be recognized for any of the registration information declared by the applicant upon enrollment.
  3. The member shall embark upon the prescribed procedure without delay in the even of a change in any registration information including address and/or telephone number.
  4. Member's registration information shall not be disclosed without the member's consent. Disclosure of information that can identify a member such as name, address, telephone number or e-mail address shall require consent of the member prior to the fact in all cases.
Article 3: Information and Services
  1. The Club shall not be obligated to investigate the completeness, accuracy, usefulness or suitability of the various types of information or services provided by the Club.
  2. The Club reserves the right to edit or rearrange manuscripts, images (including movies, still photos, illustrations, etc.), or audio provided by a third party including its membership, and members shall not object to this. The Club shall not bear any obligation concerning editing, etc.
  3. The Club does not guarantee the completeness, accuracy, usefulness or suitability of the information or services provided to the membership. The Club shall not bear any responsibility for damages (physical, psychological or financial) incurred by any member as a result of the information provided.
  4. In the event a member of the Club posts contributed contents on the Club website containing information from which a membership number, personal information or information from which an individual can be identified, it shall be regarded as disclosure to which consent was obtained as stipulated in Article 2, Item 4. The Club shall bear no responsibility for said disclosure.
Article 4: Prohibited Behavior for Members
  1. Members of the Club are prohibited from engaging in the following behavior or other similar behavior when using the service:
    •Behavior contrary to public order and morality
    •Illegal behavior
    •Electioneering or similar behavior; behavior in violation of Public Office Election Law
    •Behavior detrimental to other members or third party (copyright infringement, libel, defamation, etc.)
    •Behavior detrimental to Club operation
    •Sales over network not authorized by the Club
    •Reprinting, reproducing or redistributing contents of e-mail from the Club or the Club’s website
    •Behavior that infringes upon the bylaws of AOL, MSN, NIFTY-Serve, or any other computer communications company or contracted provider
    •Any behavior that infringes upon Club bylaws
  2. Any other behavior deemed inappropriate by the Club
Article 5: Deletion of Registration Information
  1. The Club reserves the right to delete any information registered on the network to which the following applies or may apply, without the consent of the party that registered said information:
    •Registered information deemed by the Club to come under the prohibited behavior stipulated by Article 4
    •Information for which a certain amount of time has elapsed since being registered and is no longer deemed necessary by the Club
  2. Any other information deemed inappropriate by the Club
Article 6: Sending and Receiving E-mail
  1. When sending and receiving mail to/from the Club, members shall use the e-mail address given on the registration form.
  2. The Club shall bear no responsibility for disadvantages or damages resulting from e-mail sent or received to/from an e-mail address other than the one given on the registration form.
  3. The prescribed method shall be used when replying to e-mail from the Club.
  4. The Club shall bear no responsibility for disadvantages or damages resulting from replying to e-mail from the Club by method other than the prescribed method.
  5. Contents of e-mail sent by members shall be the responsibility of said members.
Article 7: Revocation of Membership
  1. The Club may revoke membership without the member's consent if any of the following apply:
    •If a member uses membership improperly or uses the network for commercial gain
    •If a member admits providing false information on the membership form
    •Any behavior contrary to the Bylaws
  2. If membership is revoked, the member loses all rights to the network.
Article 8: Cancellation of Membership

If a member desires to cancel membership, said member must report his intentions to The Club in accordance with the prescribed procedure. The membership shall then be canceled when the request for cancellation has been processed.

Article 9: Disclaimer
  1. The Club reserves the right to investigate information exchanged among members including e-mail and contribution to the bulletin board, but shall not be obligated to do so.
  2. The Club shall bear no responsibility for disputes occurring among members, among members and third parties, or among third parties. Said disputes shall be worked out among those involved without involvement of the Club.
  3. If a conflict arises concerning service provided by the Club and a complaint is received from a member or third party, and compensation for damages or other responsibility is recognized in a court of law, when paying said compensation, the Club shall be entitled to seek from the members who caused the problem payment of all costs resulting from said conflict (including compensation for damages, cost of suit, and attorney fees).
  4. The Club shall bear no responsibility for difficulty/inability to log onto the website, if some or all of the services are incomplete, or cannot be completely provided. Users who are able to log onto the site shall not be able to seek responsibility of the Club for said obstructions.
  5. Japanese law shall apply to all conflicts concerning services provided by the Club, regardless of the details of said conflicts. Osaka District Court (simple) shall have exclusive jurisdiction over said conflicts.
Article 10: Temporary/Permanent Interruption of Service
  1. In the following cases, the Club may temporarily or permanently interrupt services partially or in their entirety without consent of concerned members:
    •In the case of periodic network system maintenance/upgrade or in the case of an emergency.
    •If it is difficult or impossible to provide services due to fire, power failure, natural disaster or any cause beyond the Club’s control.
    •In the case the Club deems that it is difficult or impossible to provide services due to an unforeseen condition.
  2. The Club shall bear no responsibility for any disadvantage or damage accompanying said condition.
Article 11: Revision/Discontinuation of Services
  1. The Club may revise or discontinue services without consent of the membership.
  2. The Club shall bear no responsibility for any disadvantage or damage accompanying said condition.
Article 12: Registration and Enquiries

As a rule, applications for membership in the Osaka Fan Club or enquiries shall not be handled by telephone. All applications for membership in the Osaka Fan Club or enquiries shall be handled by e-mail at the following address:

Article 13: Interruption of Operation

The network may suspend operation for a certain advance notice period.
